DISCRIPTION

As it is the first time for us to systematicly get knowlege of the iGEM & synthetic biology, especially the idea of open-source innovation, some concerns come to our mind in the view of intellectual property protection(IRP) , which alures the interest of one schoolmate majoring law to make further study in it. A thesis is written under our collaboration, hoping which shall make the spirit of iGEM better understood and accepted in Chinese community.

In the thesis, we make a review about the history of iGEM, the competition system and the participation degree of Chinese teams.

Then the concept of open-source is introduced, as it is originally proposed in the computer industry, laterly applied into other knowledge-intensive industry such as automobile field, proved to be an alternative approach to protect intellectual property and promote innovation. How does the open-sourse work, since brought into synthetic biology, is the second viewpoint of the thesis. In our minds, however, Synthetic biology is a new discipline, and there is a shortage in the resource dilemma for researchers. So the spirit of iGEM for sharing the open source is a great encouragement and acceleration to this field.

When it comes to the IRP, we talk about the patentability of Synthetic biology technological inventions, the influence of commercial secret law as well others like copyright law, patent law, trademark law used in Synthetic biology technological inventions.

BioBrick Public Agreement is a contract based on standardized open resource access of biological parts. In this contact, contributors can never advocate any property rights to others who use their resources, two points of which are the benefit-counterbalance principle and the incentive principle.

At last, we draw a conclusion that, open-source drives iGEM, as a competition amining at global undergraduates, an excellent illustration to stimulate the students’ interest and talents in a specific technological field.
